Regulatory and Strategic Advice for EU Nutrition and Health Claims

EAS is closely involved in monitoring EFSA, Commission and Standing Committee (Member States) claims developments and meetings on an ad-hoc basis. This enables us to provide timely advice on the EU claims approval process.

We assist companies with the following claims services:

  • Regulatory/strategic advice on nutrition and health claims made for foods and food supplement products, including:
  • Regulatory evaluation of nutrition claims and nutrient function claims according to present applicable EU rules. For 'Article 13' claims: assistance on the clarification process and indications for the post-2010 claims climate.
  • Clarifications on interpretation issues related to the EU nutrition and health claims Regulation (eg protection of proprietary data, brand name rules, specific timelines/transition periods, comments, withdrawal of dossiers etc.).
  • Analysis of EFSA opinions on similar 'Article 14/13.5' health claims and Commission Regulations on approvals/rejections in the pipeline.
EAS has also developed a unique ‘EFSA claims tracker’ working tool to assist its core clients in the area of claims in their analysis (click here for some extracts). The Excel workbook with direct internet links to opinions, keeps track of all EFSA opinions on article 14 and 13.5 claims dossiers and their status in the EU approval process.   • Health claims dossier coaching
  • Checking and cross-reading of drafted claims dossiers in terms of wording / presentation, and advice on potential improvements (in view of large number of requests timely notice for requesting this service is necessary).
  • Guidance for following the EFSA claims dossier approval process once the dossier has been submitted to EFSA.
